SB 793 California Governor signs bill to ban flavored tobacco.

California Gov. Gavin Newsom has signed into law a bill that bans the “in-store” sale of flavored tobacco products in the state.

All California tobacco retailers or employees will be prohibited from selling, offering for sale, or possessing with the intent to sell, any flavored tobacco product or a tobacco product flavor enhancer.

The effective date of this bill is still unknown.

The law does not make it a crime to possess flavored tobacco products, but it does make it illegal to sell them. Retailers could be fined up to $250 for each violation.

This bill will override any implementation of local ordinances to the sale of flavored tobacco products.

Defined by the state, characterizing flavors include tastes or aromas relating to any fruit, chocolate, vanilla, honey, candy, cocoa, dessert, alcoholic beverage, menthol, mint, wintergreen, herb, or spice.

As is the case with any anti-vaping flavor ban, SB 793 goes beyond federal regulations. Notably, the FDA has granted market approval to multiple new tobacco products in flavors other than tobacco.

This does not mean an end for vaping in California. Although in-store sales will not be allowed, online sales are still allowed and Shijin Vapor will continue to service online sales for our California customers.
